24 July, Tshwane – Two construction firms have successfully challenged the South African National Road Agency (SANRAL) in its decision to awards Routine Road Maintenance (RRM) contracts to a panel constituting 20 companies.

The High Court (Gauteng Division) in Pretoria declared the tender award “unconstitutional and unlawful and is reviewed and set aside”. This follows two separate applications by BCB Solutions (Pty) Ltd and Botle Ba Afrika Roads (Pty) Ltd to the High Court to review and set aside SANRAL’s decision to decline their bids and instead award the tenders to other bidders.

SANRAL will next week host all the bidders in a stakeholder engagement session to discuss the implications of this Court Order and map out the way forward. The roads agency also plans to host a media briefing that will comprehensively deal with all the SANRAL issues currently in the public domain (that is allegations of corruption, lawsuits and their root causes, and procurement failures and lapses). SANRAL will outline steps that are being taken to deal with any internal lapses.

Once the logistics of the above two events have been finalised, a public announcement will be made.
